1. Introduction & Agreement to Terms
Welcome to Pianist Express™ (“Pianist Express”, “we”, “us”, or “our”), a product of Piano League™ and part of Piano League LLC. These Terms of Use (“Terms”) constitute a legally binding agreement between you and Pianist Express™ governing your access to and use of our platform.
By creating an account or using Pianist Express™, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the platform.
2. Description of Services
Pianist Express™ provides a platform for users to browse and search for services and events in the music industry, including but not limited to: Teachers/Schools, Piano Movers, Piano Tuners, Collaborative Pianists, Recording Services, Photographers, Competitions, Concerts, Festivals, Concert Hall Rentals, and Practice Room Rentals. Pianist Express™ also offers a marketplace for buying and selling pianos, sheet music, and accessories.
3. Account Creation and Eligibility
To use Pianist Express™, you must create an account. By creating an account, you represent and warrant that:
- You are at least 18 years of age and have the full legal capacity to enter into this binding agreement. This platform is not intended for use by individuals under the age of 18.
- You will provide accurate, current, and complete information during the registration process and keep your account information updated.
You are responsible for safeguarding your password and are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Creating a Pianist Express™ account also constitutes creating an account with Piano League, and by doing so, you agree to the Terms of Use and Privacy Policy of both entities.
4. User Content and Listings
Members may create listings for services and events, and submit content such as reviews and ratings (“User Content”). By submitting User Content, you grant Pianist Express™ a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sub-licensable license to use, copy, modify, distribute, and publicly display such content in connection with the platform.
You represent and warrant that your User Content is accurate, not misleading, and complies with all applicable laws.
5. Prohibited Conduct
You agree not to use Pianist Express™ to:
- Post any content that is illegal, obscene, defamatory, threatening, infringing on intellectual property rights, invasive of privacy, or otherwise injurious to third parties.
- Engage in any form of harassment, threatening behavior, or discrimination against another user.
- Use the platform for any illegal purpose or in violation of any local, state, national, or international law.
- Scrape, reverse-engineer, decompile, or otherwise attempt to access the source code or underlying ideas or algorithms of the platform.
- Distribute software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.”
Pianist Express™ reserves the right, in its sole discretion, to remove any content and terminate the accounts of users who violate these rules.
6. Our Intellectual Property
All content, features, and functionality on Pianist Express™, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof (our “Content”), are owned by Piano League LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You are not permitted to use our Content without our prior written consent.
7. Verification Requirements
Pianist Express™ may require members to submit verification information or documents, including but not limited to government-issued identification, business licenses, tax forms, or proof of address. Verification is used to confirm identity, prevent fraud, and ensure listing authenticity. By using Pianist Express™, you agree to provide such documents upon request and acknowledge that refusal or submission of false documents may result in suspension or termination of your account.
8. Fees and Services
Creating an account, posting a standard listing, and browsing the platform is free. However, fees may apply for certain premium services, such as promoted listings, featured placements, or use of the marketplace for buying and selling items. All applicable fees will be clearly described on the platform. By purchasing a paid service, you agree to pay the specified fee. Unless otherwise stated, all fees are non-refundable.
9. Privacy
Your use of Pianist Express™ is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
10. Copyright Infringement (DMCA Policy)
We respect the intellectual property of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, please provide our Copyright Agent with the written information specified in the Digital Millennium Copyright Act (DMCA). Our designated Copyright Agent for notice of claims of copyright infringement can be reached at [email protected].
11. Termination
We may suspend or terminate your account and access to Pianist Express™ at our sole discretion, at any time, and without notice or liability to you, for any reason, including but not limited to a breach of these Terms. You may request the termination of your account at any time by contacting us.
12. Disclaimers and Limitation of Liability
PIANIST EXPRESS™ IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
YOU ACKNOWLEDGE THAT YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK. PIANIST EXPRESS™, PIANO LEAGUE LLC, AND THEIR OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR FROM ANY INTERACTION BETWEEN YOU AND OTHER USERS. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR OMISSIONS OF ANY USER OR THIRD-PARTY SERVICE PROVIDER.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pianist Express™, Piano League LLC, and their officers, directors, employees, and agents from all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the platform.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Bergen County, New Jersey for the resolution of any disputes.
15. Dispute Resolution by Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.
You and Pianist Express™ agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Services (collectively, “Disputes”) will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court.
Class Action Waiver: YOU AND PIANIST EXPRESS™ AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
16. General Provisions
Changes to Terms: We reserve the right to modify these Terms at any time. We will post the revised Terms on this page and update the “Effective Date.” Your continued use of the platform after such changes constitutes your acceptance of the new Terms.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pianist Express™.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
